The 2018 state legislative sessions are well under way in most states. This year, as always, there is a plethora of proposed corporate income and sales and use tax changes that would affect business taxpayers. This year is unique, however, as many of the proposed tax changes are in response to federal tax reform, including, but not limited to, bills addressing state conformity to the Internal Revenue Code post-tax reform and other proposals designed to alleviate increased burdens on in-state residents as a result of tax reform. On the sales and use tax side, there are a number of bills focusing on online retailers. While these proposals are not original to 2018, enactment of them may be more compelling in 2018 given the possibility that the U.S. Supreme Court will overturn the Quill physical presence rule this spring in the much-anticipated Wayfair case.
